Extreme Associates Petitions Supreme Court

PITTSBURGH, Pa. - After months of preparation, the Petition for Writ of Certiorari of Extreme Associates, Rob Black and Lizzy Borden has been completed and is on its way to the clerk of the United States Supreme Court – the defendants' last stop before either being absolved of all charges by the land's highest court, or before their being forced to stand trial in U.S. District Court on several counts of trafficking obscenity.
The petition, authored by attorneys H. Louis Sirkin and Jennifer M. Kinsley, ask the Supremes to rule on three questions:
"1) Whether the federal obscenity statutes, as applied to the distribution of obscenity in private ares of the Internet, violate the individual right to privately access and view obscene materials?"
"2) Whether the Court's previous determinations that the right to privately possess obscenity generates no corollary right to distribute obscenity are valid in light of the Court's emerging understanding of privacy and the advent of the Internet?"
And,
"3) Whether Lawrence v. Texas ... eliminates Congress' ability to criminalize the distribution of obscenity in private areas of the Internet based solely upon concerns for public morality?"
The questions may sound simple, but they've all been a long time in coming. They began with U.S. District Judge Gary Lancaster's excellent decision dismissing all charges against the defendants through a combination of Supreme Court rulings from Lawrence v. Texas, the case that overturned the 20-year-old Bowers v. Hardwick's criminalization of consensual adult sodomy; the First Amendment's freedom of speech clause; and the Fourteenth Amendment's guarantee of substantive due process privacy rights embodied in, among other decisions, Roe v. Wade and Griswold v. Connecticut.
That decision was overturned last December by a three-judge appeals court panel, which the entire Third Circuit then declined to review in an en banc proceeding, so the U.S. Supreme Court was the next stop.

Wondered what people thought of this aspect of US porn... American porn appears to have a growing pre-occupation with 'roughing up' the girls - it's seems to have become VERY prevalent in MAINSTREAM US porn in the last few years... I mean I've seen TONS of American porn and a fair bit of Brit stuff too and the main difference is that in mainstream Brit porn, I've never seen the girls being treated roughly, degraded/humiliated. On the other hand, it's something that US mainstream porn has seems to be leaning more and more towards. Brit porn, for me, seems very fun-orientated and no where nearly as misogynistic as our US counterparts, and that is the joy of Brit productions - everybody seems to be having FUN. Whilst I have some misgivings about Brit porn (poor production values, sometimes dodgy-looking talent etc.) the American stuff has developed this nasty streak of treating the girls badly on-screen: rough power-fucking, skull-fucking, spitting - the list goes on. Yeah, I know it's all agreed upon in advance, but thats not my point - it's why are the Americans so keen to see the girls knocked about so much? - you rarely see anything remotely fun in their stuff, just a lot of aggression.

Sascha to sue; Tim was stealing money from the company he claims

Porn Valley- Unofficial Bianca Trump day apparently extended to the Naughty Talent website this morning. Sascha, who owns the company along with several other partners, went on the site this morning to discover that another former partner Tim Myren stole back the domain name. Plus on the site were Nazi symbols along with a sprinkling of obscenities.
"The domain was signed over to me because I'm the owner of the incorporated Naughty Talent," states Sascha. "I have the paperwork and everything." According to Sascha, Myren was also able to finagle the site from Go Daddy. But the most galliing aspect of the hijack was that the site had the symbols on it this morning.
"It sounds kind of funny, and I could laugh about it too but it hit my business bad," says Sascha who happens to be German. "People are pissed. Even the people at Anarchy that Tim was pretty close to, everybody is pissed. You don't do that. It's fucked up." Sascha claims that Myren still owes him money but he hasn't really tried to collect it from him.
"But he didn't let it go," says Sascha. "He kept on fucking and fucking and fucking. And now with this Nazi-thing? This is fucked up." Sascha says the web graffiti has been cleared off the site and that he filed a report with Go Daddy.
"I will have to sue him for that and sue him for the non-compete," says Sascha who alleges that Myren was also pocketing money from producers like Jim Powers by having checks made payable to him personally instead of Naughty Talent.
"He stole money," said Sascha. Asked if Myren was now in partnership with anyone, Sascha said Wanker Wang and that he asked Wang about this episode.
"He said he was not involved in it," states Sascha.

Porn Valley- I spoke to Tim Myren Thursday night, and Myren tells me not only did he reclaim his Naughty Talent url but that he's launched a new talent agency called Sexxxy Talent. Myren is also claiming he had nothing to do with the Nazi prank this morning on the Naughty Talent site but found it highly amusing nonetheless.
"All I can say is I wouldn't know how to do that," says Myren regarding what was posted on the site.
"All I want to say and Sascha should know this- Karma is a bitch," Myren continued. "I got my names back and everything. I got back everything legally on my company, and he's just talking a lot of stuff about Jim Powers and Anarchy. That's all bullshit. He can say what he wants to say. I don't care. But it came down to the fact I that I got back everything that he took. He had that partner Brian- Brian quit; and a lot of people he had with him quit. This is what happens. Karma hit him. That's all there is to it. He fucked over people and I wasn't just going to sit back. I didn't say anything but I got my domain names back. Maybe something was carried a little too far in the morning but it was comical to an extent. Sorry if it offended anyone but it was comical. Everyone's got to be able to take a joke. He can sue me. He can do whatever he wants. I'm not worried about it."
According to Myren he was able to prove to Go Daddy, legally that the domains were his.
"The partner that Sascha brought in quit; his partner that wanted to make it work doesn't quit, and I didn't quit. I formed something new," says Myren. "If he went by what we wanted to do, none of this would ever have happened. None of it. It's all him to blame not me. All I want to do now is build up my agency and make it work. And now that I've got a new one, it's going good. I got some great girls there. Pretty much in two weeks I put up a site, www.sexxxytalent.com got seven girls and they're all working.
"The thing that's funny is that he claimed I was such a bad person," Myren continued. "People are still working with me. My girls are getting booked and a lot of people still like me and respect me because of who I am. And with Anarchy? He went to Anarchy and tried to get the deal I had with Anarchy taken away. I didn't do anything about that- I was just letting things go; and in the meantime I was proving to Go Daddy that these were my domain names and he took them."
I asked Myren why even bother if he already had a new agency in place.
"The only reason why is principle," said Myren. "He brought people into the company, fucked me over and figured he could get away with it. All it was was principle. I could have stayed there and done what I was doing. But he wanted to bring in somebody who knew nothing about the business and thought he could run it. Well, that person [Brian aka Arik Elise] lasted a month. I've lasted 11 years and I'll be here for 11 more. If he wants Naughty Talent back Sascha can go on the Internet and say, you know what? I'm sorry for everything that I did and I was wrong; and I'll give it back to him because I don't need it. I got Sexxxy Talent and it's doing great. I've been in business for two weeks. If I was such a bad person, I wouldn't be in business.
"They stole the company from me," Myren continues. "But now they don't have the domain name."
Sascha in his interview with me today made it sound like he got the domain back from Go Daddy, but Myren says this is also bullshit.
"He didn't get it back," Myren says emphatically. "He can't get it back no matter what. I proved up and down with Go Daddy. I have documents that I owned it. I have documents that I bought it. The contract that we did with that partnership agreement? It's void. No one's in that agreement any more. It was void pretty much when he told me I can't do my job and in the contract it says what my job is."
Getting back to Brian, aka Arik Elise, Myren points out that Brian was an adult actor along with his wife.
"Sascha met him at a bar- he was a bartender. A week ago he went back to bartending. That proves if you don't know the business you're not going to succeed. I'm sorry but I know the business. The thing is the people and friends that Sascha had working for him are all gone. It's just him and there's a reason for that. Sascha can talk as much crap as he wants but in the end I'm going to prove that I'm not the person that he thinks that I am if that makes sense."Myren says that he was at Adultcon with a booth touting his new agency and by the end of this month he expects to have 15 girls on his roster
"They're all working and everyone's happy. I'm getting calls every day for bookings."
I was curious what happened to Myren's brother in all of this. I used to see him on shoots driving the girls. Myron says his brother wasn't cut out for the business and returned to the hotel industry.
"I knew this business wasn't for him and I encouraged him to go back." On another note, Myren says while he and Chico Wang are good friends, Wang isn't his business partner as Sascha suggested. Wang also called me to emphasize that point.
"There is no partnership," said Chico laughing about Sascha's conspiracy theories. And, regarding Myren, Wang says he supports him.
"Why? I like to shoot girls," Wang continues. "I like to shoot girls covered with ejaculate." Wang also suspects that Sascha may have overreached in his attempts to start an agency and probably has too many irons in the fire.
"You can't be an Octopus and expect to pick up cornflakes," Wang comments sagely, noting also that Sascha told him if he doesn't book Sascha then he can't use any of the girls from the Naughty Talent agency. Besides, said Wang, he's not shooting a Beaver Chomping Gopher line any time soon.
"Sascha can sue me any day he wants," Wang continued. "I'll pay for it by selling my semen if I have to. I support all agencies, but Sascha's a dipshit."

BALTIMORE - Gina Lynn told AVN.com Thursday that she has left Club DVD and is now a free agent for the first time in over two years.
Lynn starred in three titles for Club, Gina Lynn Reinvented and Flash 1 and 2, while two additional titles have yet to be released.
“I was under contract for a little over two years, and I didn’t get anything out of it,” Lynn told AVN.com Thursday from Baltimore, where she is appearing at the grand opening of the Scores gentlemen’s club there tonight. “I was off the market for video production. They weren’t very organized and they didn’t know what to do with distribution. People thought I was retired.”
Lynn continued, “Even for talent to think I was retired was kind of crazy. In the two years time I was with them, they just recently put out the third movie. The whole time I was willing and waiting to work, and they were paying me and that was great, but it wasn’t productive for me. The magazine is great. I love that part of it, the exposure of the magazine, but the communication on the video side wasn’t there, and the editors [of the magazine] didn’t know what to say to me. They didn’t have the power to make decisions over video production.”
Jay Annis, a consultant to Paragon Publishing, Club’s parent company, is in charge of Club DVD, but he was unavailable for comment at press time. Club magazine’s U.S. Editorial Manager, Lisa Massaro, on Thursday addressed Lynn’s remarks.
“I cannot argue that it was not a productive two years for Gina, which I very much regret,” Massaro told AVN.com. “If this is considered a stall in her career, it is considered the fault of Club DVD and not the fault of Gina Lynn. Moving into video production seemed a logical progression for us, but we did jump into it before we organized our company to be able to actually do it.”
Massaro continued, “I believe her anger and frustration is warranted. I am frustrated and disappointed about what Club DVD was unable to do in the past two years, but Gina is great. She’s gorgeous, hardworking, and so willing to do whatever you ask her to do. Frankly, any other company would be lucky to have her.”
Lynn said that she also was not pleased with Club’s preparation for her appearances at trade shows.
“It was upsetting to me,” she said. “In the middle of February, we put everything on the table and talked about how we felt, and as of now I am not with anybody. I’m a free agent, but if I decide to work for other people, I’m going to be selective. I have to have the [box] cover, and be the star of the movie. I’m not sure what I’m going to do. I want to work for the bigger companies, and do the type of movies that I haven’t done. I could do gonzo with anybody.”
Lynn said that she didn’t know that Flash 2 had been released, and wishes she could’ve promoted it.
“I promote everything that I’m in as long as I’m involved in it,” she said. “The lack of communication, it was ridiculous. I was in constant communication with the magazine editors but they couldn’t give me any answers. I love Club, they’re good people. I just think they weren’t ready on the video production end of it.”
Meanwhile, Massaro indicated that Club still has several photo layouts featuring Lynn that will be published in upcoming issues of the magazine. Lynn and Brittney Skye are on the cover of the June issue, and there is a girl/girl pictorial with Sandee Westgate coming later in the year.
“There are six to eight more layouts that we have every intention of running. We love Gina as a model and a performer. It was our malfunction that we were not able to produce and release the DVD material with her,” Massaro said.
She continued, “We love Gina Lynn, and when it came to us signing her as our first DVD and magazine contract girl it was very exciting for us and we were thrilled that she agreed to take on the task, which unfortunately in hindsight we were just not up to. We still have the greatest affection and respect for Gina Lynn and wish her nothing but the best in her career.”

JM Productions Receives 2 Adam Film World Awards

Chatsworth, CA – JM Productions has always had an excellent working relationship with the good folks over at Adam Film World (AFW). This relationship, built on the strength of JM’s quality filth and tons of free liquor for the magazine’s editors, has been a fruitful one, resulting in numerous excellent reviews and past awards for JM’s movies. And this past year things have been just as rewarding, as AFW has once again honored JM, this time with 2 awards: Best On-Going Series for Attention Whores and Best Bukkake Series for Lesbian Bukkake.

CHATSWORTH, Calif. - AVN Hall of Fame performer Kylie Ireland has launched a new company called SlutWerkz devoted exclusively to porn by women who are or have been talent.

SlutWerkz is all about making dirty, nasty porn, porn for raincoaters, if you will. Although I would like to think that sexually adventurous women and couples would also enjoy the hardcore filth I am producing and directing, SlutWerkz is female directors making gonzo for men."
Aside from Ireland, some of the other women on SlutWerkz' directing slate (either with titles already in the can or soon to be shot) include: Kami Andrews, Ginger Lynn, Julie Night, Sandra Romain, Lauren Phoenix, Renee Pornero, Katja Kassin and Lilith Eden, who Cross hinted is "an extremely well-known retired performer who will be making an anonymous comeback only for SlutWerkz under this nom d'porn."

PHOENIX - Federal indictments charging seven counts of interstate trafficking in obscene material were reportedly unsealed today against JM Productions and its principal Jeff Steward, as well as retailer/Internet distributor Five Star Video, based in Tempe, Ariz., and what appear to be two of Five Star's principals.
The indictment charges that Five Star engaged in both physical and Web transportation of the video features Gag Factor 15 and 18 and American Bukkake 13, all of which were produced by JM, and Filthy Things 6, a Powersville Production distributed by JM.

Free Speech Coalition representative, Michelle Freridge, rebuttaled Black's accusation that the organization did not assist him in his legal fights. She explained that the Free Speech Coalition is not a legal fund, but is actually a trade organization that can start class action suits, etc.
